A federal judge has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment lacks lawful basis.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her order.
The case stems from a mistaken removal to El Salvador in March, which US authorities later acknowledged was an mistake. Following his return to the United States to face alien smuggling allegations, he was detained in immigration custody.
